FATF Recommendation 16 applies to virtual asset transfers the same way it applies to wire transfers, obligating VASPs to collect and transmit originator and beneficiary information above the $1,000 threshold.

What is the FATF Travel Rule?

Originally applied to wire transfers (FATF Recommendation 16), the Travel Rule was extended to Virtual Asset Service Providers in FATF's 2019 updated guidance. It requires that VASPs collect, retain, and transmit identifying information about the originator and beneficiary of any virtual asset transfer above a specified threshold.

As a FATF member, Nigeria has adopted this requirement. The CBN and SEC Nigeria now expect all licensed VASPs and banks serving crypto customers to comply.

The Threshold and What Data Must Travel

Threshold: USD $1,000 equivalent (approx. ₦1.6M at current rates)

Required Originator Information:

  • Full legal name
  • Account number or wallet address used
  • Physical address, national ID number, date/place of birth, OR customer identification number

Required Beneficiary Information:

  • Full legal name
  • Account number or wallet address

The Technical Challenge: Sunrise Problem

The "sunrise problem" refers to the uneven global adoption of Travel Rule obligations, a compliant VASP in Nigeria may send Travel Rule data to a non-compliant VASP in another jurisdiction that cannot receive or process it. Nigerian VASPs must have a policy for handling these scenarios.

Solutions include: delaying transaction until Travel Rule data can be verified, applying risk-based policies for non-compliant counterparties, and maintaining records of all attempted transmissions.

Unhosted Wallet Transactions

Transactions involving unhosted (self-custodied) wallets present a particular challenge, there is no receiving VASP to send Travel Rule data to. Nigerian VASPs must apply enhanced measures for unhosted wallet transactions above threshold, including obtaining and verifying the identity of the wallet owner.

VASP-to-VASP Counterparty Due Diligence

Before transmitting Travel Rule data to a counterparty VASP, Nigerian institutions must verify that the receiving VASP is itself regulated and compliant. This requires maintaining a counterparty VASP registry with:

  • Regulatory licence status in their home jurisdiction
  • AML/CFT programme confirmation
  • Technical capability to receive Travel Rule data
  • Sanctions status check

How AI Shield Nexus Automates Travel Rule Compliance

Conclusion

The FATF Travel Rule is technically demanding but operationally achievable with the right platform. As FATF mutual evaluations of Nigeria continue and CBN enforcement ramps up, VASPs that have Travel Rule compliance embedded in their transaction workflows will have a significant competitive and regulatory advantage.
